Minutes of August 4, 2014

The first business meeting for August was held August 4, 2014 at the Great Valley Middle School, Room 154, 255 N. Phoenixville Pike, Malvern, PA.

Present:

Supervisors: Frank A. Piliero, Chairman, Michael J. Rodgers, Vice Chairman, Kevin R. Kuhn, and Charlie A. Philips. Hugh D. Willig was absent.
Consultants: Randy Patry, P.E., Daniel B. Mallach A.P. A., and Mark P. Thompson, Esq.
Staff: Linda Csete, Manager, Jim Thompson, Roadmaster, Tim Hubbard, Fire Marshal and Lisa Gardner, Recording Secretary.

Announcements

Mr. Piliero announced that the September meeting would be held on Tuesday, Sept. 2nd instead of Monday due to the Labor Day holiday.

Approvals

July 7, 2014 Business Meeting Minutes

Mr. Philips moved to approve the minutes of the July 7, 2014 Business Meeting and Mr. Rodgers seconded. Mr. Piliero called for further discussion and there being none, called the vote. All were in favor.

Treasurer’s Report July 1 - 31, 2014

Mr. Rodgers moved to approve the July 2014 Treasurer’s Report and Mr. Philips seconded. Mr. Piliero called for discussion and there being none, called the vote. All were in favor.

Accounts Payable Reports for Operating Fund for August 4, 2014

Mr. Kuhn moved to approve the General Fund Accounts Payable Report for August 4, 2014 and Mr. Philips seconded. Mr. Piliero called for discussion and there being none, called the vote. All were in favor.

Accounts Payable Report for Open Space Fund for August 4, 2014

Mr. Kuhn moved to approve the Open Space Fund Accounts Payable Report for August 4, 2014 and Mr. Rodgers seconded. Mr. Piliero called for discussion and there being none, called the vote. All were in favor.

Reports

Mr. Kuhn asked the Roadmaster for an update on the 3 way stop sign at Ashenfelter and Whitehorse Roads, but Mrs. Csete volunteered to check on it. He also inquired about the intersection of Yellow Springs Road and Phoenixville Pike. Mrs. Csete said PennDOT confirmed the traffic study warranted a left turn lane onto Yellow Springs Road but no letter has been received yet. Mr. Philips asked to have the weeds at Hollow and Pikeland Roads cut by PennDOT.

Mr. Philips said he received 5 calls regarding the Volpi property, and he would like to discuss the sale process in a future Executive Session.

Mr. Kuhn moved to accept the July 2014 reports #1-14 as submitted and Mr. Philips seconded. Mr. Piliero called for discussion, and there being none, called the vote. All were in favor

Hearings

Devault Village at Spring Oak Conditional Use Application

Mr. Thompson opened the Hearing that had been continued from July 7, 2014 for the Conditional Use Application for Devault Village at Spring Oak. The proceedings were recorded by Mark Hagerty, Court Reporter.

John Jaros, Esq. introduced Spring Oaks engineer, Mr. Jason Engelhardt, P.E. He distributed a handout(A1-A3) while giving the Board an overview of the development’s amended

Conditional Use Application.

Mr. Thompson asked for comments from the audience, and there were none. Mr. Thompson closed the hearing at this time.

Mr. Kuhn moved to approve the conditional use application for Devault Village at Spring Oak subject to conditions to be drafted by Mr. Thompson in a written decision for the September Meeting. Mr. Rodgers seconded. Mr. Piliero called for discussion, and there being none, called the vote. All were in favor. Mr. Thompson said the Board has 45 days in which to render the written decision.

Marshall Conditional Use Application

Mr. Thompson opened the Hearing that had been continued from July 7, 2014 for the Conditional Use Application for Paul Marshall of 2226 Charlestown Road. The proceedings were recorded by Mark Hagerty, Court Reporter.

Mr. Michael Murray added Item C-1 to the exhibits on Mr. Cloeter’s behalf, which was a Great Valley School District Partnership List.

Mr. Thompson continued the Hearing to September 2nd, 2014 at 7:30 p.m. at the Great Valley Middle School, Room 154, 255 N. Phoenixville Pike, Malvern, PA.

Request for Modification to Design Manual for Spring Oak

Mrs. Leland reported on the Planning Commission’s recommendation to approve a substitution in the Design Manual for Spring Oak. The Applicant wanted the option to change from a natural stone veneer to a manufactured stone veneer for the walls and monuments. The Board was not opposed to the substitution.

General Warren Village

Mr. Philips reported on this morning’s Design Review Committee (DRC) meeting, noting that the applicant will be seeking preliminary plan approval from the Supervisors on September 2nd after first sending Members revised materials to review.

Appointment of Part-Time Property Manager

This item was tabled.

Authorize Advertising of Bids – Brightside Farm

Mr. Randy Patry updated Supervisors regarding the bid documents for the improvements discussed at the July 7th meeting for the Brightside Farmhouse, including replacement of the beams on one side of the house and pouring a floor in the basement. There will be a PreBid Meeting and the bid will be designed so interested parties can bid to design or according to their proposed alternatives. Bids will be opened at the October meeting.

Mr. Kuhn moved to authorize Advanced GeoServices, Inc. to post and advertise the Brightside Farmhouse Improvement Project Invitation to Bid on the PennBid website, with a bid opening date of October 6th, 2014. Mr. Philips seconded. Mr. Piliero called for discussion, and there being none, called the vote. All were in favor.

Pickering Crossing Escrow Release #10

Mr. Philips moved to approve Escrow Release #10 for Pickering Crossing, and Mr. Rodgers seconded. Mr. Piliero called for discussion, and there being none, called the vote. All were in favor.

Other Business

Mr. Philips will be emailing Supervisors asking for comments regarding a Fee in Lieu for Recreational Use for Devault Village at Spring Oak. Mrs. Leland also said that Mr. Allen was concerned about how to track and record changes to Design Manuals. Mr. Philips said the consultants should be responsible for tracking this data.

Mr. von Hoyer, of the Planning Commission, gave the following updated estimate for the nearby Atwater Residential project in East Whiteland Township:

Mr. Piliero announced there would be an Executive Session after the meeting tonight.

Adjournment

Mr. Piliero adjourned the meeting at 10:15 p.m. The next meeting is scheduled for Tuesday, September 2, 2014, 7:30 p.m. at the Great Valley Middle School, Room 154, 255 North Phoenixville Pike, Malvern, PA.
