Board of Supervisors Business Meeting
Minutes of October 17, 2005

The second business meeting for October was held October 17, 2005, at the Great Valley Middle School, Room 154. Kevin R. Kuhn, Chairman, Mike Rodgers, Vice Chairman, Paul Hogan, Hugh Willig, Gary Bender, Esq., Surender Kohli, P.E., Linda M. Csete, Township Administrator, and those on the attached list were present.

The meeting was called to order at 7:46 P.M.

Announcements

Mr. Kuhn announced that executive sessions were held October 3rd and October 6th, 2005 to discuss legal, personnel and employee matters.

Citizen’s Forum/Non-Agenda Items

No matters were brought forward at this time.

Approvals

Minutes of October 3, 2005

Mr. Rodgers moved to approve the October 3, 2005 minutes, and Mr. Willig seconded. Mr. Kuhn called for discussion, and there being none called the vote. All were in favor.

New Business

Charlestown Woods (Maureen Berg) Final Subdivision Plan

John Berg and Tom Smith of Conver & Smith Engineering presented the final subdivision plan for Maureen Berg that proposes 3 lots on 17 acres off Charlestown Road.

Mr. Berg said the grading work is completed and that the PennDOT engineer has inspected it and advised him the highway occupancy permit will be issued shortly. Minor comments are expected on the NPDES permit within the week. Mr. Kuhn asked if there would be guide rails installed, but Mr. Kohli said PennDOT determined they’re not needed. Mr. Kuhn asked if a car sliding off the road in winter would continue off the road and reach the pond. Mr. Berg said the pond is far from the road, and that the new grading and rip-rap should correct the water problem in that area. Mr. Rodgers asked if the area will be re-forested. Mr. Allen said yes, but trees must be set back far enough to maintain the sight distances. He said it creates an unnatural look but is necessary. Mr. Berg added that all the trees will be replaced. Mr. Willig asked if the rip rap will remain exposed, and Mr. Berg answered yes, if it was vegetated it would lose its effect. Mr. Smith added that the matting will be seeded.

Mr. Willig moved to recommend approval of the Final Subdivision Plan for Maureen Berg last revised 9/2/05 subject to the comments of Mr. Kohli’s review letter dated 10/3/05. Mr. Rodgers seconded, and Mr. Kuhn called for discussion. Mr. Kuhn asked if the conservation easement had been finalized. Mr. Berg said yes, the documents were delivered to the Township office some months ago. The easement is held by the Natural Lands Trust. Mr. Kuhn called the vote, and all were in favor.

Approval of Checks

Mr. Rodgers moved to approve the following checks:

# 3815 to the CCATO for Fall Convention for $150.00
# 3816 the caterer for Open Space Event expenses $1,400.00
# 3817 to the musician for the Open Space Event $275.00

Mr. Willig seconded. Mr. Kuhn called for discussion, and there being none called the vote. All were in favor.

Schedule Hearing for Lighting Amendment to the Zoning Ordinance

The Hearing for the Lighting Amendment to the Zoning Ordinance was scheduled for Monday, November 21, 2005, 7:30 P.M. at the Great Valley Middle School, Room 154.

Schedule Hearing for the Guest House Amendment to the Zoning Ordinance

The Hearing for the Guest House Amendment to the Zoning Ordinance was scheduled for Monday, November 21, 2005, 7:30 P.M. at the Great Valley Middle School, Room 154.

Phoenixville Area Soccer Club and Phoenixville Marion Youth Club Insurance Coverage

This matter was tabled.

Allan A. Myers Curative Amendment Application

The proceedings were recorded by Tom Corcoran, Court Reporter. No testimony was given as the applicant had previously requested a continuance. The hearing was continued to November 21, 2005.

Robal Associates

Mr. Kuhn opened the hearing for Robal Associates, and the proceedings were recorded by Tom Corcoran, Court Reporter. James Tupitza, Esq. represented the applicant. Mr. Bender called the following witnesses, who gave testimony, followed by cross-examination:
