Board of Supervisors Business Meeting
Minutes of August 25, 2017

The second business meeting for August was held August 25, 2017 at the Township Office, 4030 Whitehorse Road, in Malvern, PA.

Charles A. Philips, Vice Chairman, Michael J. Rodgers, and Kevin R. Kuhn. Frank A. Piliero and Hugh D. Willig were absent.

Announcements

Mr. Kuhn announced that he spoke to Bob Dettore about the repairs and painting needed for the bridge across Pickering Road. Mr. Dettore was of the opinion that the entire bridge should be re-painted instead of the spot repairs suggested by the PennDOT bridge inspection report. This could cost up to $300,000 due to the need to tent the bridge because of the Pickering Creek underneath. He’ll also obtain a price for a precast bridge replacement so the Board can consider all options.

Resolution to Authorize Execution of Settlement Agreement

Mr. Rodgers gave background details on the settlement agreement between the Tredyffrin Township Municipal Authority and the townships and municipal authorities of East Whiteland, Easttown, Willistown, Malvern Borough, East Pikeland, Schuylkill, Charlestown, and the Valley Forge Sewer Authority, of which the latter three townships are members.

Mr. Kuhn moved to adopt resolution #892-2017, authorizing Charlestown Township’s execution of the Settlement Agreement agree to the sale of the Valley Creek Trunk Sewer system. Mr. Philips seconded. Mr. Philips called for discussion, and there being none, called the vote. All were in favor.

Mr. Kuhn made the following two motions:

  1. To engage Dilworth Paxson LLP as special transactional counsel, with payment and engagement terms to be controlled by the provisions of the Wilson Road Force Main/Valley Creek Trunk Sewer Settlement Agreement approved this same date, and per the Dilworth Paxson LLP engagement letter dated 6/13/17.
  2. To engage PFM Group as special transactional consultant, with payment and engagement terms to be controlled by the provisions of the Wilson Road Force Main/Valley Creek Trunk Sewer Settlement Agreement approved this same date, and per the PFM Group engagement letter undated.

Mr. Philips seconded. Mr. Philips called for discussion, and there being none, called the vote. All were in favor.

Other Business

Wireless Communications Ordinance

Mr. Thompson said he met with Mr. Wright and Mrs. Csete about 3 weeks ago to work out details for the proposed wireless communications ordinance. The draft ordinance will be circulated to the Board so they can authorize advertising and schedule a hearing at their September 5th meeting, with the hearing to open October 2nd.

Adjournment

Mr. Philips adjourned the meeting at 2:35 p.m. The Board held an executive session immediately following the meeting to discuss legal matters.
