Minutes of June 17, 2013

A special meeting was held June 17, 2013 at the Charlestown Township Office, 4030 Whitehorse Road, Devault, PA.

Acquisition of Parcel #35-4-85, Subdivision Services

Mr. Kuhn moved to adopt Resolution #810-2013 authorizing the condemnation and acquisition of Parcel #35-4-85. Mr. Philips seconded. Mr. Piliero called for discussion, and there being none, called the vote. All were in favor.

Mr. Kuhn made a motion to approve Resolution #811-2013 to authorize Lamb, McErlane, PC to spend up to $900,000 with Acquired Capital to purchase the property. Mr. Rodgers seconded. Mr. Piliero called for discussion, and there being none, called the vote. All were in favor.

Mr. Thompson indicated that there is an agreement in principle with Acquired Capital. The plan is to close the deal by the end of the month.

Discuss Provisions of the Traditional Neighborhood Development Ordinance

Mr. Thompson explained that the current TND ordinance requires that all utilities be placed in the rear of residential units. In order to allow screened gas meters to be placed in the front, the Board can grant an exception. The Board agreed that gas meters for interior units could be in front with required screening. End unit gas meters will be on the side. Mr. Philips made a motion to grant the exception as stated, and Mr. Kuhn seconded. Mr. Piliero called for discussion, and there being none, called the vote. All were in favor.

Other Business

Decorative Street Light Poles along Route 29 Corridor

Planning Commissioner Mike Allen asked Mr. Thompson to produce a document to ensure that the Township will not be responsible for the engineering work concerning the decorative light poles along the Route 29 corridor. Mr. Thompson agreed there needs to be something in writing.

Thompson Property Acquisition

Mr. Kuhn said he heard back from Schuylkill Township that they were not splitting the fees expended by Charlestown Township on the Thompson tract even though there was a handshake agreement. The Solicitor will prepare documents for the next meeting to pursue the funds.

Update on Electric Utility Placement for Pickering Cross

Tim Townes of J. Loew & Associates gave an update on the placement of all utilities for Pickering Cross except gas meters. They will use a third party electric contractor, Nationwide Energy, to install electric service with meters in the rear of the buildings as required by the TND Ordinance.

Marshall Proposal to Amend Zoning Ordinance

Planning Commission Chair Wendy Leland asked the Board of Supervisors for some guidance in handling the Marshall zoning request. Mr. Piliero informed the Planning Commission that they need to conclude their discussions and make a recommendation to the Board.

Mr. Kuhn suggested that the Adaptive Re-Use Ordinance be reviewed to see if changes should be made.

Mr. Piliero adjourned the meeting at 8:25 p.m. The next meeting is scheduled for Monday, July 1, 2013, 7:30 p.m. at the Great Valley Middle School, Room 154, 255 North Phoenixville Pike, Malvern, PA.
