Board of Supervisors Business Meeting
Minutes of June 18, 2007

The second business meeting for June was held June 18, 2007 at the Great Valley Middle School, Room 154. Kevin Kuhn, Chairman, Michael Rodgers, Vice Chairman, Paul Hogan, Hugh Willig, Mark Thompson, Esq., Surender S. Kohli, P.E., Linda M. Csete, Township Administrator, and those on the attached list were present.

Mr. Kuhn called the meeting to order at 7:32 P.M.

Announcements

Mr. Hogan said the weedwhacker is in need of repair but a credit at the repair shop will cover the cost.

Open Space Director Aliena Gerhard announced that the Township received word last week of a grant award from the DCNR in the amount of $388,000 to help preserve three farms in the Township. This grant, added to the $500,000 received from the County over the past year is over ¾ of a million dollars. The Township is anticipating word from the County on another grant application within the next few weeks.

Approvals

Minutes of June 4, 2007 Business Meeting

Mr. Rodgers moved to approve the minutes of the June 4, 2007 business meeting, and Mr. Hogan seconded. Mr. Kuhn called for discussion, and there being none, called the vote. All were in favor.

Accounts Payable Report – Operating Fund June 18, 2007

Mr. Rodgers moved to approve the June 18, 2007 Operating Fund Accounts Payable Report and Mr. Hogan seconded. Mr. Kuhn called for discussion and then the vote. All were in favor.

New Business

Open Road Equipment & Labor Bids

The following bid for road labor & equipment rental was opened and read aloud:

Melchiorre Construction Company $ 388,900

The bid documents were turned over to Mr. Kohli for review and recommendation.

Desfor Land Development Agreement and Tri-Party Agreement

Stuart Lurie, Esq. stated he represented Michael and Carolyn Desfor and has spoke at length with Mr. Thompson about the land development and tri-party agreements for the Desfors’ land development plan for an equestrian center on their property at the corner of Merlin & Yellow Springs Roads. He said he has executed copies of the agreements and seven sets of the land development plans for recording with him this evening. He requests approval of these documents and expedition of the issuance of the grading permit for the project.

Mr. Thompson said he’s spoken to Mr. Lurie as late as this afternoon, and hasn’t seen the documents yet in order to review them. He said the two agreements were prepared using the township’s format and suggested that approval be subject to his and Mr. Kohli’s review.

Mr. Kohli said that before the plans and agreements are recorded, the health department, highway occupancy and NPDES permits must be issued from the respective agencies. An E & S permit must be approved by the Township, followed by the building permit itself.

Mr. Thompson said the Township will expect a full release from pending litigation at the time of plan recordation as he discussed previously with Mr. Lurie.

Mr. Kuhn moved to approve execution of the Land Development Agreement and Tri-Party Agreement for the Desfor Land Development project subject to Mr. Thompson’s and Mr. Kohli’s review, and Mr. Willig seconded. Mr. Kuhn called for discussion and there being none, called the vote and all were in favor.

Hearings

Altemose Curative Amendment Application

Mr. Thompson opened the hearing for the Altemose Curative Amendment application, and the proceedings were recorded by Tom Corcoran, court reporter. There was no testimony. The hearing was continued to July 2, 2007 at 7:30 P.M. at the Great Valley Middle School, Room 154.

Traditional Neighborhood Development Ordinance

Mr. Thompson opened the hearing for consideration of adoption of the Traditional Neighborhood Development ordinance. The proceedings were recorded by Tom Corcoran, court reporter. The following exhibits were entered into the record:

A presentation on the proposed ordinance will be given by the Planning Commission at the next hearing. The hearing was continued to July 2, 2007 at 7:30 P.M. at the Great Valley Middle School, Room 154.

The meeting was adjourned at 8:00 P.M. The next meeting is scheduled for July 2, 7:00 P.M. in Room 154 of the Great Valley Middle School.
