Board of Supervisors Business Meeting
Minutes of July 18, 2005

The second business meeting for July was held July 18, 2005, at the Great Valley Middle School, Room 154. Kevin R. Kuhn, Chairman, Mike Rodgers, Vice Chairman, Charles Philips, Paul Hogan, James E. McErlane, Esq., Gary Bender, Esq., Surender Kohli, P.E., Linda M. Csete, Township Administrator, and those on the attached list were present.

The meeting was called to order at 7:37 P.M.

Announcements

Mr. Kuhn announced that an executive session was held after the July 11, 2005 meeting to discuss legal matters, and that one will be held after this evening’s meeting to discuss real estate matters.

Citizen’s Forum/Non-Agenda Items

No matters were brought forward at this time.

Approvals

Minutes of July 11, 2005

Mr. Rodgers moved to approve the July 11, 2005 minutes, and Mr. Philips seconded. Mr. Kuhn called for discussion, and there being none called the vote. All were in favor.

Hearings

Stephen and Karen Wicke, Conditional Use – construction of pool in steep slopes, Lot #2 at the Highlands @ Charlestown

Jim McErlane, Esq. opened the hearing for the application, and the proceedings were recorded by Tom Corcoran, Court Reporter. The following witnesses gave testimony:

The hearing was closed.

Mr. Hogan moved to approve the conditional use application of Stephen and Karen Wicke subject to the comments on Mr. Kohli’s and Mr. Comitta’s review letters dated 7/5/05 and 7/6/05 respectively, and further subject to the applicant working with Thomas Comitta Associates on screening and landscaping the proposed use. Mr. Rodgers seconded. Mr. Kuhn called for discussion, and there being none, called the vote. All were in favor. The Board will render a written decision within 45 days.

Desfor Farms, Conditional Use Application

Jim McErlane, Esq. opened the hearing for the application. Mr. Kuhn recused himself due to a family business relationship with the applicant. Mr. Rodgers was appointed acting chairman. The proceedings were recorded by Tom Corcoran, Court Reporter. Michael Gill, Esq. represented the Applicant.

A binder with all exhibits was submitted to Mr. McErlane and members of the Board.

The hearing was closed. The Board will render its decision within 45 days.

Mr. McErlane asked the applicant when the topographical data and Environmental Assessment Report will be ready. Mr. Gill responded with an estimate of 3 ˝ to 4 weeks.

Mr. Rodgers returned the chair to Mr. Kuhn.

Robal Associates

Mr. McErlane opened the hearing for Robal Associates, and the proceedings were recorded by Tom Corcoran, Court Reporter. James Tupitza, Esq. represented the applicant, Robert Bruce Balbirnie, who was also present.

Lillmars Conditional Use

Jim McErlane, Esq. opened the hearing for Carl Lillmars, and the proceedings were recorded by Tom Corcoran, Court Reporter. The applicant was represented by James Tupitza, P.E., who requested a continuance.

The hearing was then continued to September 19, 2005 at 7:30 P.M. in Room 154 of the Great Valley Middle School.

Adjournment

Mr. Kuhn moved to adjourn and Mr. Rodgers seconded. The meeting was adjourned at 9:55 P.M. The next meeting is scheduled for August 1, 2005, 7:30 P.M. in Room 154 of the Great Valley Middle School.
